Terms and conditions

MyOpsAlly is a service of Apex Technology LLC ("we", "us"). These terms cover the MyOpsAlly text messaging program on our toll-free number, this website, and MyOpsAlly when a business uses it on its own phone line, website chat or text number.

Text messaging program

  1. Program. MyOpsAlly text messages from our toll-free number. MyOpsAlly is the only sender. We reply to people who text us with questions about MyOpsAlly.
  2. Opt-in. You opt in by texting our number first. Consent comes from that text, not from accepting these Terms or our Privacy Policy, and it is not a condition of any purchase or service. We reply only within the conversation you started. We do not send marketing.
  3. Frequency. Message frequency varies with the conversation.
  4. Cost. Message and data rates may apply. Check your mobile plan.
  5. Stop. Reply STOP to any message to stop all texts. You will get one confirmation and no further texts. Reply START, YES or UNSTOP to receive texts again.
  6. Help. Reply HELP for help, or email james@myopsally.us.
  7. Carriers. Carriers are not liable for delayed or undelivered messages.
  8. Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are never shared with third parties. See our Privacy Policy.

When a business uses MyOpsAlly

A business can put MyOpsAlly on its own phone line, website chat or text number. Texts on a business's own number are sent under that business's own registration and its own terms, not under this program.

MyOpsAlly uses automated software, including AI, to read messages and draft replies. An order taken this way is a request to the business, not a confirmed order: a person at the business confirms it before anything ships or is scheduled. Prices, stock, delivery times and anything the business has to decide come from the business, not from MyOpsAlly. When MyOpsAlly cannot answer something from the business's own information, it hands the conversation to a person at the business.

Your purchase, delivery, appointment and payment are between you and that business, on its terms. We are not a party to that sale and are not responsible for the goods or services the business provides.

Acceptable use

Do not use MyOpsAlly to send unlawful, abusive or threatening messages, to impersonate someone else, or to try to get at information that is not yours. We may stop responding to a number that does.

No warranty and limit of liability

MyOpsAlly is provided as is. Messages can be delayed, filtered by a carrier or not delivered, and automated replies can be wrong. Do not rely on a text for anything urgent or safety related: call the business. To the extent the law allows, Apex Technology LLC is not liable for indirect or consequential losses arising from the use of MyOpsAlly.

Changes

We may update these terms. The date at the top shows the current version. Material changes to the text messaging terms will not apply to messages sent before the change.

Governing law

These terms are governed by the laws of the State of Kansas.
